Decision on appeal against decisions of the examining magistrate on granting threatened witness status under Section 226a DCCP with regard to the MH17 trial. Decisions on granting such status are subject to limited review. The suspect was wrongly deprived of the opportunity to be heard on the prosecutor’s applications prior to the decisions. In this instance, the decisions were, however, not set aside provided that the suspect was later afforded that opportunity. That did not happen in the case of one witness and so that decision was set aside.
